This Privacy Policy ("Policy," "Privacy Policy," or "Notice") explains how AdChats LLC dba GenLeads.com ("AdChats," "GenLeads," "we," "us," or "our") collects, processes, uses, and discloses personal information in connection with our websites (the "Sites") and the related content, products, services, and other functionality offered on or through the online services, including where you interact with GenLeads through mobile applications and/or websites that have integrated with GenLeads's advertising platform either directly or via an advertising exchange (collectively, the "Services").

GenLeads is an advertising platform that enables advertisers to serve advertisements on third-party mobile applications and/or websites owned or operated by partners or to which a partner has the right to serve advertising.

Data Processor Commitment: When our advertisers deliver advertisements or use our Services to submit, manage, or otherwise use content relating to our advertisers' data ("Advertisers Data"), we have contractually committed ourselves to only process such information on behalf of and under the instruction of the respective advertiser, who is the "data controller." This Privacy Policy does not apply to such processing and we recommend you read the privacy notice of the respective advertiser if their processing concerns your personal information.

2. Information We Collect

We collect personal information about individuals when an individual ("End User") interacts with our Services, such as viewing the ads, clicking the ads, browsing the GenLeads official homepage, etc.

2.1. Automatically Collected Information

As is true of many digital properties, we may automatically collect certain information from or in connection with users' and other website visitors' devices when visiting or interacting with our Services:

  • Device Data: including internet protocol (IP) address, operating system, device type and version, browser type and version, the URL entered and the referring page/campaign, date/time of visit.
  • Analytics data: including the path taken to our Services, through our Services, and when exiting our Services, usage and activity on or in connection with our Services, metrics on how many links are opened, clicked, or viewed (such as via pixels), web log data and other information normally transmitted in HTTP/HTTPS requests.
  • Location data: such as approximate geolocation from your device's IP address.
  • Advertising/Advertising Measurement Data: including data associated with your view of, or click on, advertisements served on our Services, cookie IDs or other digital or proprietary identifier assigned to such device, and device metadata described above, for purposes of serving advertising (personalized or otherwise). When you interact with our AI-powered chatbot or conversational interface (collectively, "Chatbot Services"), we collect the following information:

  • Conversation Data: including all messages, questions, responses, and other content you provide during your interaction with our Chatbot Services, as well as the AI-generated responses and conversation history.
  • Contact Information: including your name, email address, company name, job title, industry, phone number (if provided), and any other personal or business information you voluntarily provide during the conversation.
  • Behavioral Tracking Data: including your browsing behavior on our Sites such as pages visited, time spent on each page, scroll depth, click events, navigation patterns, and interaction history. This data is collected passively to provide context-aware and personalized chatbot interactions.
  • Session Information: including unique session identifiers, session start time, referrer information, and session duration.
  • Computed Intent Data: including AI-generated assessments of your primary interests, engagement scores, predicted pain points, and intent classifications based on your browsing behavior and conversation patterns.
  • Conversation Metadata: including conversation round numbers, conversation state, selected options or quick replies, and timestamps for each message exchange.

The Chatbot Services use artificial intelligence and machine learning technologies to analyze your behavior and conversation patterns to provide personalized responses and recommendations. By using our Chatbot Services, you consent to the collection and processing of this information as described in this Privacy Policy.

3. How We Use Your Information

We collect the above-mentioned information for various purposes, including:

  • To fulfill your requests and provide our Services: Making our Services available to you and our advertisers; Serving you with relevant and personalized advertisements; Auditing and reporting; Providing ad campaign analytics; Coordinating access to advertisers' account; Responding to requests and providing user support.
  • To personalize your experience: We use personal information to tailor the content that we display on our Sites in order to provide users with a personalized experience.
  • Chatbot and Conversational AI Services: We use your conversation data, behavioral tracking data, and contact information to:
    • Generate context-aware and personalized chatbot responses based on your browsing behavior and conversation history
    • Calculate intent scores and engagement metrics to understand your interests and needs
    • Provide dynamic conversation flows and recommendations tailored to your specific interests and pain points
    • Follow up with you regarding your inquiries, including sending case studies, product information, or other materials you request

4. How We Share and Disclose Information

We may share your information in the following ways:

  • Our Affiliates: This includes other brands owned or controlled by AdChats LLC and other companies owned by or under common ownership with GenLeads. These companies will use your personal information in the same way as we can under this Privacy Policy.
  • Third-Party Service Providers: Currently, we do not share any information from you to any third-party service partners and providers for their independent marketing purposes. We only share data with vendors who facilitate our core technical operations under strict data processing agreements.
  • At Your Direction: With your consent or at your direction.

5. Cookies and Tracking Technologies

We use cookies and mobile advertising IDs to manage and provide our online services. Cookies are tiny files downloaded to your computer that allow us to collect information about your interaction with our Services. We also utilize mobile advertising IDs (Google advertising ID on Android and IDFA on iPhone) to improve our advertising service.

We automatically collect log data about your device and software: IP address, operating system, browser type, date/time of visit, and analytics data helping us measure usage and activity trends. We also collect approximate location data based on IP address.

6. Data Retention

We store personal data no longer than necessary for the purposes set out in this Privacy Policy, considering the amount, nature, and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the data, and whether we can achieve those purposes through other means, as well as applicable legal requirements.

Chatbot Data Retention: Conversation data, behavioral tracking data, and contact information collected through our Chatbot Services are retained for as long as necessary to fulfill the purposes for which they were collected, including responding to your inquiries, providing follow-up communications, and improving our AI services. We may retain anonymized or aggregated conversation data and behavioral patterns for longer periods for analytics and AI model improvement purposes, provided such data cannot be used to identify you personally. You may request deletion of your chatbot conversation data at any time by contacting us at info@genleads.com.

7. International Data Transfers

The personal data we collect may be transferred to and stored in countries outside of your jurisdiction, including the United States. In such cases, we ensure the transfer is made pursuant to appropriate safeguards, such as standard data protection clauses adopted by the European Commission or other applicable legal mechanisms to ensure an adequate level of data protection.

8. Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information. These rights may include:

  • Right of Access: Request information relating to your personal information we have collected and disclosed, including your chatbot conversation history, behavioral tracking data, and computed intent assessments.
  • Right to Request Deletion: Request the deletion of personal information we have collected from you, including chatbot conversation data and behavioral tracking information, subject to certain exceptions (such as where we are required to retain data for legal compliance or where data has been anonymized and cannot be used to identify you).
  • Right to Rectification: Obtain rectification of inaccurate or incomplete data, including correction of any personal information you provided during chatbot conversations.
  • Right to Portability: Receive a copy of your data in a structured, machine-readable format, including your chatbot conversation transcripts and associated metadata.
  • Right to Object: Object to processing based on our legitimate interests or for marketing activities, including objecting to the use of your behavioral tracking data for AI personalization purposes.
  • Right to Withdraw Consent: You have the right to withdraw your consent at any time where processing is based on consent, including withdrawing consent for behavioral tracking used in chatbot personalization. Note that withdrawing consent may affect the functionality and personalization of our Chatbot Services.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.

Chatbot-Specific Rights: In addition to the above, you have the right to:

  • Request a copy of your complete chatbot conversation history
  • Request deletion of specific conversations or all chatbot-related data
  • Opt-out of behavioral tracking that is used to personalize chatbot interactions (you may still use the chatbot, but it will not be personalized based on your browsing behavior)
  • Request that we do not use your conversation data for AI model training or improvement purposes

9. Children's Privacy

Our Services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13. If an individual is under the age of 13, they should not use our Services. If we learn that any personal information we collect has been provided by a child under the age of 13, we will promptly delete that personal information.

The Services are not directed at persons under 16 in the European regions. We do not knowingly collect personal data from any persons under the age of 16.

The Services operate on third party websites and may contain links to third party websites of our business partners, advertisers, social media sites, and our advertisers may post links to third party websites. If you follow a link to any of these websites, please note that these websites have their own privacy notices and policies and that we do not accept any responsibility or liability for their policies.

3. Disclosure of Personal Information

Verification: We will need to verify your identity and confirm you are a resident of California. This may require the matching of sufficient information you provide us to the information we maintain about you (e.g., cookie ID, mobile ID, IP address).

Authorized Agents: You are permitted to use an authorized agent to submit requests on your behalf where we can verify the agent's authority to act on your behalf via power of attorney or signed permission.

Response Time: We will respond to your request within the timeframes required by applicable California law.

This European Privacy Notice applies if you are located in the European Economic Area (EEA), United Kingdom (UK), or Switzerland.
