This Privacy Notice explains how AdChats LLC dba GenLeads.com (“AdChats,” “GenLeads,” “we,” “us,” or “our”) collects, processes, uses, and discloses personal information in connection with our websites (the “Sites”) and the related content, products, services, and other functionality offered on or through the online services, including where you interact with GenLeads through mobile applications and/or websites that have integrated with GenLeads’s advertising platform either directly or via an advertising exchange (collectively, the “Services”).

GenLeads is an advertising platform that enables advertisers to serve advertisements on third-party mobile applications and/or websites owned or operated by partners or to which a partner has the right to serve advertising.

Data Processor Commitment: When our advertisers deliver advertisements or use our Services to submit, manage, or otherwise use content relating to our advertisers’ data (“Advertisers Data”), we have contractually committed ourselves to only process such information on behalf of and under the instruction of the respective advertiser, who is the “data controller.” This Privacy Notice does not apply to such processing and we recommend you read the privacy notice of the respective advertiser if their processing concerns your personal information.

1. Information We Collect

We collect personal information about individuals when an individual (“End User”) interacts with our Services, such as viewing the ads, clicking the ads, browsing the GenLeads official homepage, etc.

Automatically Collected Information

As is true of many digital properties, we may automatically collect certain information from or in connection with users’ and other website visitors’ devices when visiting or interacting with our Services:

  • Device Data: including internet protocol (IP) address, operating system, device type and version, browser type and version, the URL entered and the referring page/campaign, date/time of visit.
  • Analytics data: including the path taken to our Services, through our Services, and when exiting our Services, usage and activity on or in connection with our Services, metrics on how many links are opened, clicked, or viewed (such as via pixels), web log data and other information normally transmitted in HTTP/HTTPS requests.
  • Location data: such as approximate geolocation from your device’s IP address.
  • Advertising/Advertising Measurement Data: including data associated with your view of, or click on, advertisements served on our Services, cookie IDs or other digital or proprietary identifier assigned to such device, and device metadata described above, for purposes of serving advertising (personalized or otherwise). We may also process information about your interactions with any advertisements we deliver, such as information about the advertisements served, viewed or clicked on, and any preferences you may have expressed.

2. How We Use Your Information

We collect the above-mentioned information for various purposes, including:

  • To fulfill your requests and provide our Services: Making our Services available to you and our advertisers; Serving you with relevant and personalized advertisements; Auditing and reporting; Providing ad campaign analytics; Coordinating access to advertisers’ account; Responding to requests and providing user support.
  • To personalize your experience: We use personal information to tailor the content that we display on our Sites in order to provide users with a personalized experience.
  • To monitor, improve, and develop our products: analyzing statistics and trends to make our Services better, to develop new services and features, and to understand what features our users are interested in.
  • To protect the security and integrity of our business: complying with legal requirements, protecting our company, affiliates, and advertisers. We may use information in order to comply with laws, regulations, court orders, or other legal obligations or to assist in an investigation.
  • Corporate Transactions: We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets.

3. How We Disclose Your Information

We may share your information in the following ways:

  • Our Affiliates: This includes other brands owned or controlled by AdChats LLC and other companies owned by or under common ownership with GenLeads. These companies will use your personal information in the same way as we can under this Privacy Notice.
  • 3rd party service providers: Currently, we do not share any information from you to any 3rd party service partners and providers for their independent marketing purposes. We only share data with vendors who facilitate our core technical operations under strict data processing agreements.
  • At your direction: With your consent or at your direction.

4. Third-Party Links

The Services operate on third party websites and may contain links to third party websites of our business partners, advertisers, social media sites, and our advertisers may post links to third party websites. If you follow a link to any of these websites, please note that these websites have their own privacy notices and policies and that we do not accept any responsibility or liability for their policies.

5. Children’s Personal Information

Our Services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13. If an individual is under the age of 13, they should not use our Services. If we learn that any personal information we collect has been provided by a child under the age of 13, we will promptly delete that personal information.

We may be required by law to provide different or additional information relating to the processing of personal information about residents of certain regions:

  • Notice to EU individuals: If you are located in the EEA, UK or Switzerland, please see the European Privacy Notice below for additional European-specific privacy information including the lawful bases we rely on and your rights.
  • Notice to Nevada consumers: Chapter 603A of the Nevada Revised Statutes permits a Nevada resident to opt out of future sales of certain covered information. Please contact us at info@genleads.com to submit such a request.

CALIFORNIA PRIVACY NOTICE

1. SCOPE OF NOTICE

This California Privacy Notice (the “CA Notice”) supplements the information contained in our Privacy Notice above and applies solely to individual residents of the State of California (“consumers” or “you”) within the scope of the California Consumer Privacy Act of 2018 (CCPA).

2. COLLECTION AND USE OF PERSONAL INFORMATION

In the last 12 months, we have collected the following categories of personal information:

  • Internet/Network Information: such as device meta information, logs and analytics data;
  • Geolocation Data: such as your approximate location based upon your IP address;
  • Inferences: such as information generated from your use of the Services reflecting predictions about your interests and preferences.

We collect this from: directly from you, from your browser or device when you use our Services, or from third parties that you permit to share information with us.

3. DISCLOSURE OF PERSONAL INFORMATION

As described in Section 3 of our main Privacy Notice, we do not share any personal information with third parties for their direct marketing purposes. We do not "sell" personal information as traditionally defined, but may share identifiers for cross-context behavioral advertising.

4. YOUR CALIFORNIA PRIVACY RIGHTS

  • The Right to Access/Know: Request information relating to your personal information we have collected and disclosed in the last 12 months.
  • The Right to Request Deletion: Request the deletion of personal information we have collected from you, subject to certain exceptions.
  • The Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.
  • “Shine the Light”: California residents that have an established business relationship with us have rights to know how their information is disclosed to third parties for their direct marketing purposes.

5. HOW TO EXERCISE YOUR RIGHTS

Verification: We will need to verify your identity and confirm you are a resident of California. This may require the matching of sufficient information you provide us to the information we maintain about you (e.g., cookie ID, mobile ID, IP address).

Authorized Agents: You are permitted to use an authorized agent to submit requests on your behalf where we can verify the agent’s authority to act on your behalf via power of attorney or signed permission.

EUROPEAN PRIVACY NOTICE

This European Privacy Notice applies if you are located in the EEA, UK or Switzerland.

1. Personal Data and Legal Bases

We process your personal data automatically collected (Device data, Analytics, etc.) under the following legal bases:

  • Legitimate Interests: To monitor and resolve issues with the Services, to improve the Services generally, and to inform our direct marketing.
  • Consent: Where required by law, we will only use your personal data to serve you relevant and personalized advertisements to the extent you have given us consent.

2. Storage and International Transfers

Storage: We store personal data no longer than necessary for the purposes set out, considering the amount, nature, and sensitivity of the data.

International Transfers: The personal data we collect may be transferred to and stored in countries outside of your jurisdiction, including the United States. In such cases, we ensure the transfer is made pursuant to appropriate safeguards, such as standard data protection clauses adopted by the European Commission.
